Background
In 2021, as a result of the labor reform, it was established that companies that provide specialized services had de obligation to obtain their REPSE registration before the Ministry of Labor and Social Prevision, which is valid for 3 years, meaning that in this year 2024, the renewal of those registrations authorized in 2021 must be completed, in order for the companies that provide specialized services to continue with their activities in accordance with the dispositions stablished in the Federal Labor Law (“Ley Federal del Trabajo”), and avoid the cancellation of their registration or any possible sanction by the authority.
Recent Developments
On February 21st, 2024, the Government issued an Agreement regarding the general provisions for the registration of individuals or legal entities that provide specialized services or perform specialized works referred to in Article 15 of the Federal Labor Law.
Those registrations made in 2021, are subject to renewal; however, registrations obtained in subsequent years will remain for a three-year period.
As for the renewal of the registration of individuals or legal entities listed in the Registry, the Ministry of Labor and Social Provision, through the platform http://repse.stps.gob.mx will enable a module called “Registration Renewal”, which may only be accessed only within the specified period of validity of their first registration, regardless of whether they have made an actualization or modification to their registration.
This agreement establishes that at the time of requesting registration or renewal, the individual or legal entity that provides specialized services must be in compliance with its tax and social security obligations.
In addition, and as the main requirement, the authority will require documents on qualification, certifications, authorizations or licenses, equipment, assets, capital stock, average salary range as well as other documents.
Once the information and the requested documents have been verified, the authority must decide on the registry or renewal request within 20 business days following the submission of the application on the platform.
After obtaining the renewal of the registration, it is necessary for the specialized service provider to inform the beneficiaries of its services of the renewal of the REPSE registration.
