{"id":4052,"date":"2026-04-22T09:00:07","date_gmt":"2026-04-22T09:00:07","guid":{"rendered":"https:\/\/www.ibarrapg.com\/?p=4052"},"modified":"2026-04-22T20:19:23","modified_gmt":"2026-04-22T20:19:23","slug":"repeal-of-article-three-of-the-transitory-provisions-of-the-decree-on-gender-matters-and-access-to-a-life-free-of-violence","status":"publish","type":"post","link":"https:\/\/www.ibarrapg.com\/en\/repeal-of-article-three-of-the-transitory-provisions-of-the-decree-on-gender-matters-and-access-to-a-life-free-of-violence\/","title":{"rendered":"Mexico City\u2019s Repeal of Article Three of the Transitory Provisions of the Decree on Gender and Violence &#8211; Free Life for Women"},"content":{"rendered":"<p style=\"text-align: justify;\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">The purpose of this note is to inform you that, on April 10<sup>th<\/sup><\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">, 2026, a decree was published in the Official Gazette of Mexico City, whereby the <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Congress of Mexico City repealed Article Three<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> of the <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Transitory Provisions<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> of the Decree amending the Penal Code for the Federal District (the \u201c<\/span><span style=\"text-decoration: underline;\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-strikethrough-none text-decoration-underline\">Mexico City Penal Code<\/span><\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-strikethrough-none text-decoration-none\">\u201d) and the Civic Culture Law, originally published on December 24<span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"><sup>th<\/sup><\/span><\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-strikethrough-none text-decoration-none\">, 2025. This decree entered into force the next day: April 11<span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"><sup>th<\/sup><\/span><\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-strikethrough-none text-decoration-none\">, 2026.<\/span><\/p>\n<h4 style=\"text-align: justify;\">Background<\/h4>\n<p style=\"text-align: justify;\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">On December 24<sup>th<\/sup><\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">, 2025, a decree was published in the Official Gazette of Mexico City amending and supplementing various provisions of the Mexico City Penal Code and amending the Civic Culture Law, in the subjects of <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">gender and access to a life free of violence for women<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">. Such decree included four transitory provisions (First, Second, Third, and Fourth), of which the Third is now subject to repeal.<\/span><\/p>\n<h4 style=\"text-align: justify;\">Practical Implications<\/h4>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\" style=\"text-align: justify;\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">The <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">repeal<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> of Article Three of the Transitory Provisions eliminates the specific provision established therein regarding the <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">stages implementation or phased entry into force<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> (or any other stipulation) of the December 2025 amending decree. The First, Second, and Fourth Transitory Provisions remain in full force and effect. It is advisable to review the specific content of the repealed Third Transitory Provision in order to determine whether any obligation, deadline, or special regime ceases to have effect as of April 11<sup>th<\/sup><\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">, 2026.<\/span><\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\" style=\"text-align: justify;\"><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Companies, institutions, and individuals<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> with <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">obligations <\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">or procedures linked to the December 2025 decree should: <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">(i)<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> identify whether the Third Transitory Provision established any transitional regime applicable to <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">their operations<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">; <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">(ii)<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> verify that their <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">compliance processes<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> are aligned with the regulatory framework absent the repealed provision; and <\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"><strong>(iii)<\/strong> <\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">remain attentive to any <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">official interpretation<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> or guidance issued by the authorities of Mexico City regarding the scope of such repeal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">The repeal of Article Three of the Transitory Provisions does not affect the substantive content of the December 2025 decree; the amendments to the Criminal Code and the Civic Culture Law in matters of gender remain fully in force and effect. As of April 11<\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none font-size-modifier vertical-align\">t<span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"><sup>th<\/sup><\/span><\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">, 2026, any term, authorization, or special regime established by such provision is no longer legally effective, while the First, Second, and Fourth Transitory Provisions continue to apply without modification. It is recommended to verify whether the Third Transitory Provision granted any specific term or exception applicable to your operations and to remain attentive to any interpretative criteria that may be issued by local authorities.<\/span><\/p>\n<h4><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Labor Implications<\/span><\/h4>\n<p style=\"text-align: justify;\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">The repeal of that article removes a rule that clearly stated that ongoing criminal matters must be handled in accordance with the law in effect at the time of the events.<\/span><\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\" style=\"text-align: justify;\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">In the labor context, <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">companies<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> need to be careful about how they <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">investigate<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"> and determine <\/span><strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">disciplinary actions<\/span><\/strong><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">. It is essential to thoroughly memorialize when the <\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\"><strong>events<\/strong> <\/span><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">occurred, which policy was in place, and why a particular decision was made.<\/span><\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\" style=\"text-align: justify;\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">When this is unclear, cases tend to weaken in labor court, even if the conduct occurred.<\/span><\/p>\n<p class=\"cvGsUA direction-ltr align-justify para-style-body\" style=\"text-align: justify;\"><span class=\"a_GcMg font-feature-liga-off font-feature-clig-off font-feature-calt-off text-decoration-none text-strikethrough-none\">Finally, in cases of <strong>harassment, bullying, or violence,<\/strong> the risk to the company increases if there is no <strong>internal policy <\/strong>in place. The recommendation is simple: <strong>handle each case consistently, avoid ad-hoc decisions, and ensure that Human Resources\u2019 actions align with the applicable legal framework, including the Federal Labor Law<\/strong>.
