{"id":3756,"date":"2026-04-15T00:10:46","date_gmt":"2026-04-15T00:10:46","guid":{"rendered":"https:\/\/www.ibarrapg.com\/?p=3756"},"modified":"2026-04-15T00:10:46","modified_gmt":"2026-04-15T00:10:46","slug":"amendment-to-article-141-of-the-mexican-federal-tax-code","status":"publish","type":"post","link":"https:\/\/www.ibarrapg.com\/en\/amendment-to-article-141-of-the-mexican-federal-tax-code\/","title":{"rendered":"Amendment to Article 141 of the Mexican Federal Tax Code"},"content":{"rendered":"<p style=\"text-align: justify;\">On April 9th, 2026, the Decree amending Article 141 of the Mexican Federal Tax Code (\u201c<span style=\"text-decoration: underline;\">CFF<\/span>\u201d) was published in the Official Gazette of the Federation (\u201c<span style=\"text-decoration: underline;\">DOF<\/span>\u201d), regarding the methods for securing the fiscal interest of the Federation. This reform reverses the mandatory order of priority for providing guarantees that had been adopted as of January 1st, 2026.<\/p>\n<p style=\"text-align: justify;\">The amended text provides that taxpayers may guarantee the fiscal interest \u201cthrough any of the forms\u201d set forth in the Article itself, such forms no longer being subject to a mandatory order of priority.<\/p>\n<p style=\"text-align: justify;\">Procedures for securing the fiscal interest initiated between January 1st, 2026, and the entry into force of the reform in question, as well as guarantees established during such period, may be governed by the amended provisions, provided that the taxpayer expressly requests this before the tax authority within 30 calendar days following the reform\u2019s entry into force.<\/p>\n<p style=\"text-align: justify;\">For guarantees already in place, their substitution shall not interrupt the suspension of the administrative enforcement procedure nor give rise to any additional requirements.
