{"id":2927,"date":"2026-01-22T17:00:04","date_gmt":"2026-01-22T17:00:04","guid":{"rendered":"https:\/\/www.ibarrapg.com\/?p=2927"},"modified":"2026-03-31T14:29:06","modified_gmt":"2026-03-31T14:29:06","slug":"mexico-enacts-the-general-circular-economy-law","status":"publish","type":"post","link":"https:\/\/www.ibarrapg.com\/en\/mexico-enacts-the-general-circular-economy-law\/","title":{"rendered":"Mexico enacts the General Circular Economy Law"},"content":{"rendered":"<p style=\"text-align: justify;\">The purpose of this notice is to inform you that, on January 19th, 2026, the General Circular Economy Law (the \u201c<span style=\"text-decoration: underline;\">Law<\/span>\u201d) was published in the Official Gazette of the Federation (<em>Diario Oficial de la Federaci\u00f3n<\/em>, the \u201c<span style=\"text-decoration: underline;\">DOF<\/span>\u201d), establishing a new mandatory environmental regime with significant implications for companies across various economic sectors.<\/p>\n<p style=\"text-align: justify;\">This Law represents a structural shift in environmental regulation in Mexico, as it introduces progressive obligations related to the design, operation, consumption, and waste management of products and services.<\/p>\n<h4 style=\"text-align: justify;\">General Impact on Businesses<\/h4>\n<p style=\"text-align: justify;\">The Law formally introduces Extended Producer Responsibility (\u201c<span style=\"text-decoration: underline;\">EPR<\/span>\u201d) in Mexico, which entails that producers and importers must assume responsibility for the environmental impact of their products throughout their entire life cycle, from design through final disposal.<\/p>\n<p style=\"text-align: justify;\">This represents a significant shift, as responsibility is no longer limited to the production phase, but extends to stages such as use, repair, reuse, recycling, and waste recovery.<\/p>\n<p style=\"text-align: justify;\">In general terms, the following subjects will be bound by the Law:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Producers and importers of goods and products.<\/li>\n<li>Companies operating under service-based models, where such services generate significant environmental impacts.<\/li>\n<li>Sectors that are incorporated through general implementation agreements to be issued by the Ministry of Environment and Natural Resources (<em>Secretar\u00eda de Medio Ambiente y Recursos Naturales<\/em>, \u201c<span style=\"text-decoration: underline;\">SEMARNAT<\/span>\u201d) (e.g., construction, energy, tourism and manufacturing, among others).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">The implementation will be gradual and sectorspecific; however, once the relevant sector agreement is published, compliance will be mandatory for such sector.<\/p>\n<p style=\"text-align: justify;\">One of the core pillars of the Law is the <strong>obligation to file a \u201cCircular Management\u201d strategy<\/strong> with SEMARNAT.<\/p>\n<p style=\"text-align: justify;\">Companies will be required to register their Circular Management strategy when:<\/p>\n<ul style=\"text-align: justify;\">\n<li>They are covered by a general EPR implementation agreement published in the DOF.<\/li>\n<li>They produce or import products, or provide services, with significant environmental impacts.<\/li>\n<li>They elect to comply with circular economy obligations through direct or indirect mechanisms (e.g., recycling, reuse, environmental offsets).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">The Circular Management strategy shall include an analysis of the life cycle of the product or service, attainable goals for the reduction of the environmental footprint, mechanisms for reuse, recycling, recovery or compensation, and compliance indicators and periodic reports thereof.<\/p>\n<p style=\"text-align: justify;\">Once such strategy has been submitted, the authority may authorize it, condition it, or deny it if it does not comply with the criteria set forth in the Law.<\/p>\n<p style=\"text-align: justify;\">Although the Law imposes new obligations, it also provides benefits for companies that adapt in advance, including:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Economic and tax incentives (to be defined in secondary regulations).<\/li>\n<li>Access to the National Circular Economy Distinction, with reputational and commercial value.<\/li>\n<li>Preference in public procurement for products or services that hold such distinction.<\/li>\n<li>Flexibility and phased compliance schemes for those that actively participate in early implementation.<\/li>\n<\/ul>\n<h4><\/h4>\n<h4 style=\"text-align: justify;\">Inspection, Oversight and Sanctions<\/h4>\n<p style=\"text-align: justify;\">The Law strengthens the environmental verification and inspection powers of SEMARNAT and the Federal Attorney\u2019s Office for Environmental Protection (\u201c<span style=\"text-decoration: underline;\">PROFEPA<\/span>\u201d). Failure to comply with registration, reporting, or target obligations may result in:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Administrative fines.<\/li>\n<li>Corrective measures.<\/li>\n<li>Cancellation of the Circular Management registration.<\/li>\n<li>Additional environmental liability pursuant to the General Law of Ecological Balance and Environmental Protection and the General Law for the Prevention and Comprehensive Management of Waste.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong>The General Circular Economy Law should not be viewed solely as a regulatory burden, but rather as a redefinition of the environmental standard in Mexico.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Companies that begin now to assess their processes, products, and business models will be in a better position to mitigate risks, reduce regulatory costs, and capitalize on opportunities in an environment increasingly focused on sustainability.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The purpose of this notice is to inform you that, on January 19th, 2026, the General Circular Economy Law (the \u201cLaw\u201d) was published in the Official Gazette of the Federation (Diario Oficial de la Federaci\u00f3n, the \u201cDOF\u201d), establishing a new mandatory environmental regime with significant implications for companies across various economic sectors.
