{"id":1536,"date":"2023-11-06T19:29:57","date_gmt":"2023-11-06T19:29:57","guid":{"rendered":"https:\/\/www.ibarrapg.com\/?p=1536"},"modified":"2026-04-06T18:01:35","modified_gmt":"2026-04-06T18:01:35","slug":"notice-disclosing-the-sustainable-buildings-certification-program-of-mexico-city","status":"publish","type":"post","link":"https:\/\/www.ibarrapg.com\/en\/notice-disclosing-the-sustainable-buildings-certification-program-of-mexico-city\/","title":{"rendered":"Notice Disclosing the Sustainable Buildings Certification Program of Mexico City"},"content":{"rendered":"<p style=\"text-align: justify;\">Published in Mexico City\u2019s Official Gazette by the Ministry of the Environment of CDMX (&#8220;<span style=\"text-decoration: underline;\">SEDEMA<\/span>&#8220;) on November 6th, 2023 (the &#8220;<span style=\"text-decoration: underline;\">Notice<\/span>&#8220;).<\/p>\n<p style=\"text-align: justify;\">SEDEMA is responsible for developing programs that promote self-regulation and environmental auditing. In accordance with this authority and the 2015 commitment before the United Nations, the Notice highlights the seventeen sustainable development goals, including: <strong>i)<\/strong> &#8220;Reducing inequality within and among countries&#8221;; <strong>ii)<\/strong> &#8220;Making cities and human settlements inclusive, safe, resilient, and sustainable&#8221;; and <strong>iii)<\/strong> &#8220;Promoting peaceful and inclusive societies for sustainable development, ensuring access to justice for all, and building effective, inclusive institutions at all levels,&#8221; among others.<\/p>\n<p style=\"text-align: justify;\">To comply with the foregoing principles and environmental policies, SEDEMA issues the Notice.<\/p>\n<h4 style=\"text-align: justify;\">Purpose and Scope of Validity<\/h4>\n<p style=\"text-align: justify;\">The Sustainable Buildings Certification Program (either &#8220;<span style=\"text-decoration: underline;\">PCES<\/span>&#8221; or &#8220;<span style=\"text-decoration: underline;\">Program<\/span>&#8220;) is a self-regulation initiative aimed at promoting the reduction of pollutants and efficient use of natural resources during the design, construction, and operation of buildings in Mexico City. It is based on a certification process focusing on sustainability actions and compliance indicators, also seeking social benefits to enhance the quality of life for residents in Mexico City.<\/p>\n<p style=\"text-align: justify;\">The Program is aimed at buildings in Mexico City at the design, construction, and operation stages, destined for residential, commercial, service, recreational, entertainment and mixed-use purposes. Participation in the program is voluntary.<\/p>\n<p style=\"text-align: justify;\">Definitions:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Design and Construction Stage:<\/strong> The phase of the project involving conceptual development, building construction, or facility modifications.<\/li>\n<li><strong>Operation Stage:<\/strong> The phase of building occupancy and use, including its main systems.<\/li>\n<\/ul>\n<h4 style=\"text-align: justify;\">Certification Procedure<\/h4>\n<p style=\"text-align: justify;\">1. Registration<\/p>\n<p style=\"text-align: justify;\">The Notice outlines the procedure and requirements for the applicant to follow to carry out the actions outlined in the implementation plan. This is to obtain the Sustainable Building Certificate, issued by SEDEMA, accrediting the successful completion of the PCES.<\/p>\n<p style=\"text-align: justify;\">The process is managed by SEDEMA through the General Directorate of Impact Assessment and Environmental Regulation (either &#8220;<span style=\"text-decoration: underline;\">DGEIRA<\/span>&#8221; or &#8220;<span style=\"text-decoration: underline;\">Director<\/span>&#8220;) with the assistance of an implementer. The implementer, authorized by SEDEMA through DGEIRA, serves as the guide and advisor for the building during the certification process. They are responsible for producing the diagnostic report, implementation plan, implementation report, and certificate revalidation report (&#8220;<span style=\"text-decoration: underline;\">Implementer<\/span>&#8220;).<\/p>\n<p style=\"text-align: justify;\">Applicants must submit their program registration request to DGEIRA, which will assess the provided documentation. If no observations or corrective actions are required, DGEIRA will issue a Registration Agreement.<\/p>\n<p style=\"text-align: justify;\">Subsequently, the applicant must submit a Building Diagnostic Report (&#8220;<span style=\"text-decoration: underline;\">Diagnostic Report<\/span>&#8220;), prepared and signed by the implementer chosen from the Program&#8217;s implementers list. The report includes an evaluation of the building&#8217;s compliance with applicable environmental laws and existing sustainability actions. The Diagnostic Report is accompanied by the implementation plan, outlining the actions the applicant will take to address legal and sustainability compliance, application documentation, and support for compliance indicators and sustainability actions (&#8220;<span style=\"text-decoration: underline;\">Implementation Plan<\/span>&#8220;).<\/p>\n<p style=\"text-align: justify;\">Upon acceptance by SEDEMA through DGEIRA, applicants can request modifications to the Diagnostic Report and Implementation Plan, subject to approval by DGEIRA.<\/p>\n<p style=\"text-align: justify;\">2. Implementation<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Design and Construction Stage:<\/strong> Implementation follows the construction schedule, with progress reports submitted to DGEIRA every ninety calendar days from the program registration notification. The completion of the implementation plan should align with the notice of use and occupancy.<\/li>\n<li><strong>Operation Stage:<\/strong> The completion of the implementation plan is within one hundred and twenty natural days after the program registration notification.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">In both cases, applicants must inform DGEIRA about the completion of the implementation plan within ten business days after its conclusion. This is done through the submission of the implementation report, including: <strong>i)<\/strong> a description of the actions taken to comply with environmental regulations and sustainability actions; <strong>ii)<\/strong> technical and documentary evidence supporting the previous point; and <strong>iii)<\/strong> the release of environmental impact conditions, in the case of design and construction modality (&#8220;Implementation Report&#8221;).<\/p>\n<p style=\"text-align: justify;\">The Certification Procedure may be extended once upon request by the applicant, subject to DGEIRA approval.<\/p>\n<p style=\"text-align: justify;\">3. Certification<\/p>\n<p style=\"text-align: justify;\">If there are no observations or once they are addressed, SEDEMA through DGEIRA will issue the corresponding Certificate Issuance Agreement. This agreement includes information on validity, certificate type (based on the building&#8217;s stage), baseline compliance indicators, a list of implemented sustainability actions, compliance goals, and continuous improvement objectives.<\/p>\n<h4 style=\"text-align: justify;\">Sustainable Building Certificate<\/h4>\n<p style=\"text-align: justify;\">The sustainable building certificate is the document issued by SEDEMA accrediting the successful completion of the PCES (either &#8220;<span style=\"text-decoration: underline;\">CES<\/span>&#8221; or &#8220;<span style=\"text-decoration: underline;\">Certificate<\/span>&#8220;).<\/p>\n<p style=\"text-align: justify;\">Once obtained, applicants must display the CES prominently or provide a photocopy. This is done to inform all building occupants about the compliance indicators and implemented sustainability actions. Additionally, through a written statement signed by the legal representative, applicants may express their interest to SEDEMA in publishing the certification results, general characteristics, and building location through channels determined by SEDEMA.<\/p>\n<p style=\"text-align: justify;\">1. Characteristicas<\/p>\n<ul style=\"text-align: justify;\">\n<li>The Certificate is non-transferable;<\/li>\n<li>It has a validity of three years, provided that: <strong>i)<\/strong> conditions for issuance are maintained or improved; <strong>ii)<\/strong> the annual Program follow-up report is submitted;<\/li>\n<li>It loses validity when: <strong>i)<\/strong> there is a failure to submit the annual Program follow-up report; <strong>ii)<\/strong> there is non-compliance with any applicable legal environmental regulation; and iii) there is a modification to facilities or operating conditions without prior notice to SEDEMA;<\/li>\n<li>SEDEMA through DGEIRA can verify, through a technical recognition visit, that the conditions for which the Certificate was granted remain compliant;<\/li>\n<li>The CES can be revalidated if requested from DGEIRA at least forty-five business days before its expiration. This request must include the documentation outlined in the Notice.<\/li>\n<\/ul>\n<h4 style=\"text-align: justify;\">Sustainability Actions<\/h4>\n<p style=\"text-align: justify;\">Sustainability actions are those adopted by the applicant that address environmental areas, enhancing the overall environmental performance of the building, and minimizing the environmental, economic, and social impact during construction and operation in Mexico City.<\/p>\n<p style=\"text-align: justify;\">Implemented sustainability actions must be grouped and included in the Diagnostic Report, Implementation Plan, or Implementation Report, as applicable, by category and environmental indicator. This is done to aggregate the results of each action and determine the overall environmental performance improvement of the building.<\/p>\n<p style=\"text-align: justify;\">Below are the categories outlined in the Notice, along with their sustainability actions.<\/p>\n<p style=\"text-align: justify;\">1. Category: Energy Savings and Efficiency<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">Sustainability Actions:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Reduction in Electrical Energy Consumption:<\/strong> Aims to implement activities in the building to reduce electrical energy consumption, regardless of its source, and promote efficient use through the acquisition, installation, operation, and maintenance of equipment, systems, and policies.<\/li>\n<li><strong>Generation and Consumption of Renewable Energy:<\/strong> Aims to substitute energy consumption from the electrical grid or fuels through all activities related to the generation of electrical and thermal energy on-site and the consumption of energy from renewable sources.<\/li>\n<li><strong>Reduction in Fuel Consumption:<\/strong> Aims to implement activities in the building to reduce fuel consumption, regardless of its source, and promote efficient use through the acquisition, installation, operation, and maintenance of equipment, systems, and policies.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">2. Category: Water Savings and Treatment<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">Sustainability Actions:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Reduction in Water Consumption:<\/strong> Aims to implement activities in the building to reduce water consumption, regardless of its source, and promote efficient use through the acquisition, installation, operation, and maintenance of equipment, systems, and policies.<\/li>\n<li><strong>Use of Rainwater and Treated Water Inside or Outside the Building:<\/strong> Aims to substitute the consumption of potable water from the network through all on-site water treatment activities, consumption of treated water from outside the building, as well as the collection and use of rainwater.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">3. Category: Proper Waste Management<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">Sustainability Actions:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Reduction and Valorization of Waste:<\/strong> Aims to prevent, minimize, and reduce waste generation, as well as utilize and valorize waste.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">4. Category: Quality of Life and Social Responsability<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">Sustainability Actions:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Implementation of Environmental and Social Education Campaigns:<\/strong> Aims to disseminate topics related to environmental education inside and outside the building through any means.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">5. Category: Mitigation of Environmental Impacts<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">Sustainability Actions:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Green Area Surface:<\/strong> Aims to conserve, install, construct, and maintain green areas inside the building, as well as adopt green areas outside the building.<\/li>\n<li><strong>Use of Recycled Materials:<\/strong> Aims to acquire and use materials, supplies, and products with recycled content to reduce the environmental impacts of the building.<\/li>\n<li><strong>Reduction and Capture of Greenhouse Gases Inside and Outside the Building:<\/strong> Aims to apply activities, inside or outside the building, to reduce, capture, or mitigate direct or indirect emissions of greenhouse gases generated by the operation of buildings.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Compliance with sustainability actions does not exempt the applicant from compliance with applicable environmental legal frameworks.<\/p>\n<h4 style=\"text-align: justify;\">Transitory Provisions<\/h4>\n<p style=\"text-align: justify;\">This Program renders ineffective the sustainable building certification program published in the Official Gazette of Mexico City on December 23th, 2020.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Published in Mexico City\u2019s Official Gazette by the Ministry of the Environment of CDMX (&#8220;SEDEMA&#8220;) on November 6th, 2023 (the &#8220;Notice&#8220;).
